Judge Dismisses Most of Blake Lively’s Sexual Harassment Allegations in Lawsuit Against Justin Baldoni

According to the court documents acquired by Page Six, a federal judge has ruled in favor of dismissing 10 out of the 13 claims in Blake Lively’s lawsuit against Justin Baldoni, including those related to sexual harassment, defamation, and conspiracy.

Nevertheless, a breach of contract, retaliation, and aiding and abetting in retaliation are the three claims that will be moving forward. The court hearing is set for May 18.

Sexual harassment was Lively’s only potential claim and the reason it was denied is that, “because the court determined that Lively was an independent contractor, not an employee.”

“Actually, this matter has focused and will continue to focus on the devastating retaliation and the extreme measures that the defendants took in order to defame Blake Lively’s character after she stood up for proper working conditions, ” the statement concluded. “This is the case, which will be presented at trial.”

Furthermore, the team noted that victory for Lively is not only about publicizing the conspirators behind these digital attack campaigns, who are already facing consequences by other women whom they harassed.

Blake Lively and Justin Baldoni’s Lawyers React to Court’s Decision

Blake Lively’s representatives conveyed that the actress is willing to testify during the trial and use her voice against online harassment. “She actually intends to testify at trial and using her voice to expose this nasty form of online retaliation in order to make it easier to identify and fight, ” according to them.

On the other hand, Justin Baldoni’s lawyers told Page Six they are “really happy” that all the sexual harassment and individual defendants’ claims have been dismissed. “These were extremely serious accusations, and we thank the Court for its thorough understanding of the facts, law, and the extensive evidence that was presented, ” stated their spokesman.

“The remaining issue is a very limited one, and we are ready to show our defense to these claims in court, ” he added. Lively accused Baldoni of sexually harassing him during their time at the set of It Ends With Us and filed a lawsuit against the filmmaker at the end of December 2024. She alleges that the director’s campaign of defamation against her led to at least $161 million in lost earnings and damages.

Lately things have escalated quite a bit between Blake Lively and Justin Baldoni with sexual harassment allegations having been made, denied and even countered violently on both sides and the two of them have ended up suing each other.
It was Justin who initially filed a $400 million suit against Blake and her husband, Ryan, towards the end of 2024. However, the matter was taken back in June 2025.
So, what does this mean? Well, according to Baldoni’s attorney Bryan Freedman, the two are still at it as he said, “He has the right to take it up to the higher court if he wants.” Bryan further said, “So, our present focus is on Lively’s accusations and we are not backing off of using every appropriate legal and factual method to get to the truth.”
February 11th saw these two in court in New York they looked like they were going to work out a settlement as they had come dressed similarly but no such agreement was reached.
Unfortunately even in her complaint Lively refers to many attempts of sexual harassment Baldoni made to her while they were filming It Ends With Us. She accuses him of wrongdoing but he totally denies it.

Controversial Slow Dance Scene is the Main Reason of Blake Lively and Justin Baldoni’s Legal Dispute

Page Six got a hold of court papers that tell about a slow dance scene during the filming of It Ends With Us. Blake Lively said that Justin Baldoni “leaned in and slowly dragged his lips from her ear down to her neck while he was saying, ‘It smells so good’… When Ms. Lively later objected to this behavior, Mr. Baldoni’s response was, ‘I’m not even attracted to you.'”

In response, Baldoni’s lawyer released the behind-the-scenes video of the scene in an attempt to rebut the sexual harassment claims.

“The intended purpose of the scene was to illustrate how the two characters fell in love and desired to be close to each other. The actors are, indisputably, acting in accordance with the scene and with mutual respect and professionalism, ” Freedman told Page Six.

Blake Lively Wants ‘Day in Court’ Even as There Is a Motion to Dismiss Her Lawsuit

Back in December, Blake Lively shared that she should get her “day in court” after Justin Baldoni filed a motion to dismiss her lawsuit the previous month.
A heavily redacted 76-page court document obtained by *Page Six* claimed that Baldoni and his co-defendants “‘throwing the kitchen sink’ at Lively’s sexual harassment and retaliation claims.”
Baldoni’s lawyers, on the other hand, sharply denied Lively’s allegations and accused her of “ill-intent, desperation to gain media attention and damage Baldoni’s reputation.”
