Sia refutes drug-use accusations while husband, with whom she is separated, seeks sole custody of their 19-month-old son
Sia is in a custody battle due to the fact that estranged husband Dan Bernad has filed for sole custody of their son, Somersault “Sommi” Wonder Bernad, as per court documents obtained by E! News. In the motion dated Oct. 28, Bernad, 47, claims that the 49-year-old singer is addicted to drugs and thus, not capable of taking care of the little boy.
The pair got Sommi in March 2024 and after two years of marriage, they announced their breakup less than a year later. Sia has refuted the drug-use allegations; a representative from each side has not been able to respond to the request for a comment further immediately.

In court filings, Dan Bernad said, “Sia is a serious and immediate danger to our son,” charging the artist with “deliberately and repeatedly concealing” a hospitalization of two weeks in September and “she tested positive for barbiturates and benzodiazepines, without any legitimate medical reason.”
According to the Cleveland Clinic, benzodiazepines are sedative-hypnotic drugs that are generally prescribed for anxiety or insomnia (some of the drugs in this group are Xanax, Klonopin and Valium), while barbiturates represent a different class of sedative-hypnotics used for insomnia and seizure control.
Sia has rejected the drug-use accusations. Neither the representatives of the two sides nor the parties have responded to the requests for comments.

In addition to alleged substance use, Dan Bernad is asking for sole custody on more grounds. In a court document, he claims that Sia violated their shared legal-custody agreement by denying him visitation and by “unlawfully” transferring the written power of attorney for their son Somersault “Sommi” Wonder Bernad to his nannies.
“Sia’s behavior is not only reckless and dangerous but also clearly shows that she does not care for Summi’s safety and well-being, and for the court orders,” Bernad said, referring to her as “an unfit and unreliable parent who is struggling with substance abuse and addiction, thus, she is not able to provide safe or stable care for Summi.”

Dan Bernad — a former radiation oncologist who gave up his medical career after marrying Sia in 2022 — in his court argument that his professional background makes him “the only safe and reliable parent for our son,” stating that he is “a doctor, young, healthy and have no criminal record or drug or alcohol addiction issue.”
Sia, who has two children through adoption in 2019, denies the accusations and refers to them as “completely baseless and deceptive” in her court response obtained by E! News. She admitted that she had been addicted to drugs and alcohol for more than 15 years but claimed that she had been “completely sober for more than six months” and was following a recovery program that included weekly testing and a sober companion.

According to Sia, she was the one who had primary care and custody of Somersault “Sommi” Wonder Bernad before the separation of the couple. In her court documents, she refers to Dan as a person who “does not work” and “lives a night club, party lifestyle,” pointing to this pattern as the main reason throughout their short marriage for raising the issue of the suitability of the father. She additionally states that when he was in Los Angeles, he had only a few times with Summi and mostly in the company of nannies.
