Judge​‍​‌‍​‍‌​‍​‌‍​‍‌ Liman: Baldoni’s countersuit was unconvincing; Lively’s fee motion is still live

U.S. District Judge Lewis Liman noted that Baldoni’s countersuit claimed that Ryan Reynolds and publicist Leslie Sloane made additional statements regarding Baldoni’s behavior and that Baldoni accused The New York Times of participating in a smear campaign. However, Liman pointed out that the Wayfarer Parties “have not alleged that Reynolds, Sloane or the Times would have seriously doubted these statements were true based on the information available to them,” which is a showing necessary for defamation liability.
Liman also indicated that he informed all the parties in mid-October that he would be issuing a final judgment to close the case; only Lively reacted.
